Civil rights torts at and outside of work

Civil rights issues in and outside of the workplace often involve an individual employee’s rights to privacy and due process.  In the case of public employees, their free speech rights are also actionable causes.

Civil rights disputes between an employer and an employee generally revolve around the employer’s searches and seizures of an employee’s private sphere and surveillance of an employee’s activities in and outside of work.  An employer’s negligent or illegal disclosure of personnel records or protected health information and an employer’s placement of negative or false information in an employee file are other common types of civil rights violations.

In addition to privacy torts, defamation also becomes a common tort in employment relations when an employer publishes defamatory material about an employee during or after separation from the firm.
